Business Participation Agreement

Effective as of September 13, 2026

These terms cover business participation in Find the Idol, including digital and physical idol placements and optional business-provided offers. An accepted written order confirmation completes the agreement with 8bit Company LLC, doing business as Find the Idol.

Written confirmation and authority

This agreement becomes binding when Find the Idol and an authorized representative of your organization accept a written order confirmation that identifies this agreement and its version. Submitting an inquiry alone does not buy a placement or create an agreement. The confirmation identifies the parties, selected game, dates, locations or placement, price, payment due date, deliverables, and any expressly agreed exceptions. Keep a copy of the accepted confirmation and agreement.

A specific, mutually accepted order term controls a conflict with this agreement for that order. The Terms of Service govern account use; the Game Policies govern gameplay. An order cannot retroactively reduce an offer or prize already promised to players.

Find the Idol game packages and term

Digital Idol: $75 for one four-week game, including a digital idol placement and basic business details. No wooden object or social-media mentions are included in this option. Players can check in from outside at the authorized location.

Physical Idol: $150 for one four-week game, including a mailed wooden QR-code idol, a customizable idol page with business text, images, and links, and mentions in social-media posts about the game. An optional qualifying business offer may be added without increasing the game fee.

New locations may join up to three weeks after the game begins. The selected package remains at its standard price throughout the game, regardless of when you join. Other games and custom work use the scope and price in their accepted confirmation. Onsite installation, printed in-store materials, onsite staff training, private statistics pages, and host performance tracking are not included in the standard Find the Idol game packages.

Payment, changes, and cancellation

Pay the amount and any expressly disclosed tax or shipping charge by the date in the accepted confirmation. There is no automatic renewal. Additional work or charges require written agreement. A late-entry order states the standard price and remaining game dates before acceptance. The price stays the same throughout the game, regardless of when you join.

You may request cancellation by email. Before work begins, prepaid fees are refundable. Once work begins, Find the Idol may retain the documented value of work performed and nonrecoverable costs, up to the order price, and will refund the unused balance. If Find the Idol cancels or cannot supply the agreed service, you may accept a replacement schedule or receive a refund for undelivered services. Refunds are issued within 30 days after the amount is determined. Rights required by law remain available.

Report incorrect content, closures, or safety concerns promptly. We may temporarily remove unsafe, unlawful, or misleading material and will explain the issue and reasonable corrective steps. Material schedule, package, or price changes require written agreement; urgent safety suspensions may occur immediately.

Location access and physical idols

You must have authority to use the participating location and provide accurate business details, location coordinates, hours, and any access restrictions. Gameplay and collection must not require a purchase. Keep access safe and lawful, make staff aware of players, and do not place idols in restricted or hazardous areas.

For a physical package, Find the Idol creates and mails the wooden idol to your confirmed address. You place it inside the business, keep it accessible during the announced participating hours, and remove or cover its QR code when participation ends. The paid physical package transfers ownership of the wooden object to the business; Find the Idol retains its artwork, trademarks, and software rights. Players may scan it but may not take it.

Report shipping damage, a missing idol, or a broken QR code promptly. Find the Idol will correct manufacturing defects or an incorrect supplied code without an added charge. Replacement for later loss or damage is quoted for approval before charging. A digital placement needs no physical installation and must permit a safe check-in from the designated authorized area.

Business-provided offers

You are the provider and fund and fulfill any offer attached to your idol. Supply your business name, the exact benefit, claim instructions, location, participating hours, purchase requirements, exclusions, and any limits before activation. Staff must understand how to recognize and honor the player’s displayed offer. A scan does not process a purchase or prove that fulfillment occurred.

Offers in the standard four-week Find the Idol game must provide meaningful value or a genuine exclusive, require no purchase above $25, and not duplicate a discount already published publicly. Offers must be predetermined, not a random drawing or chance to win. Any purchase relates only to redeeming the optional offer and cannot buy collection points, a photo bonus, or better prize eligibility.

Each first collection receives at most one offer active when the award is issued. Offers in the standard four-week Find the Idol game expire 24 hours after issuance; custom games use the disclosed expiration. For approved GPS proof, issuance and the expiration countdown begin at approval. Do not retroactively shorten or change an issued offer. Honor its saved terms through expiration even if the future offer changes or your game placement ends.

Request an offer change by text to your agreed Find the Idol contact or by email. For the standard four-week Find the Idol game, the update will go live within 24 hours after receipt; an unlawful or unclear request will be flagged within that time for correction. Changes affect future awards only. Disabling an offer prevents future awards and does not cancel existing ones.

If you cannot honor an issued offer, promptly tell the player and Find the Idol and arrange the promised benefit or a mutually acceptable equivalent. You remain responsible for fulfillment and applicable consumer rights; Find the Idol does not fund your offers.

Game prizes and player information

Business placement alone does not make you the provider of a game leaderboard prize. A separate express commitment is required to fund a prize. Do not promise prizes or alter scoring outside the published game rules.

Use any player information made available only to administer participation and fulfill the requested offer. Do not copy contact lists, request unnecessary location or identity data, or enroll players in marketing without their separate permission. Your own purchase and redemption interactions are subject to your privacy responsibilities.

Brand permissions and truthful promotion

You retain ownership of the names, logos, photos, text, and other materials you provide. You authorize Find the Idol and its service providers to reproduce, resize, display, and distribute those materials to deliver and promote the agreed game. You confirm you have the necessary rights and permissions. Existing game recaps and social posts may remain as historical records; new unrelated advertising requires additional permission.

Both parties must make truthful claims and clearly identify paid sponsorships and incentivized endorsements where applicable. Do not require positive reviews or misleading endorsements. Materials supplied by Find the Idol may be used to promote your agreed participation, without implying an exclusive partnership or broader endorsement.

Responsibilities, disputes, and general terms

Each party is responsible for its own conduct, personnel, representations, and obligations. Neither party may bind the other or create a partnership, agency, or employment relationship. Participation does not guarantee player numbers, visits, sales, impressions, or a return on investment.

To the extent permitted by law, neither party is liable to the other for indirect or consequential losses arising from this agreement. This does not excuse payment, promised refunds, offer or prize fulfillment, fraud, intentional misconduct, or liability that cannot legally be limited. Each party remains responsible for direct loss caused by its breach.

Contact termsofservice@findtheidol.com to attempt to resolve a dispute. California law governs, subject to mandatory applicable law. Business disputes may be brought in the state courts in Monterey County, California, or the federal court with jurisdiction there. This business agreement does not require consumer arbitration.

Neither party is liable for delay caused by events reasonably beyond its control, but must promptly notify the other and try to reduce the impact; payment for undelivered services remains subject to the refund terms. A waiver must be express. Invalid provisions do not invalidate the remainder. Neither party may assign an order without the other party’s consent, except to a successor assuming its obligations. Changes require mutual written acceptance; later website edits do not alter an accepted order.
