Terms of Service

These Terms govern your use of the Find the Idol apps, websites, events, merchandise, and related services.

Find the Idol games can include two types of idols. A physical idol is a wooden idol placed at a participating location. Players find it in person and scan its QR code to collect it. A digital idol has no wooden object to find. Players visit the participating location and check in from their phone to save it.

Physical idols are collected when an adult account holder finds the wooden idol at the participating location and scans its QR code. For a digital idol, the adult account holder visits the participating location and checks in from their phone using the Services.

An account collection is a digital record, not ownership of the wooden object. Leave physical idols in place unless staff expressly instruct otherwise. Digital collections are personal, nontransferable account features, not cryptocurrency, NFTs, transferable property, or a promise of resale value. We aim to maintain collections while the account and Services remain available, subject to correction, deletion, suspension, and service changes described here.

The Terms also work alongside any applicable game guidelines and policies communicated through the site, apps, or event materials.

Find the Idol collects and uses information only where it has a legal basis to do so. See the Privacy Policy linked on this page for details about what information is collected, how it is used, and what choices users have.

When you join a game, Find the Idol may share account information you have provided, including your public handle, name, city, state, and email address, with that game’s hosts and sponsors to administer the game, communicate about your participation, and support related offers. Joining a game does not automatically subscribe you to unrelated marketing from hosts or sponsors; separate permission may be required for those messages.

With your permission, Find the Idol may access and use your device's precise location for two gameplay purposes: to verify that you are within the required proximity of an idol when you attempt to collect it, and to display your current position on a game map so you can understand your location in relation to nearby idols. While the map is open, your location may be accessed repeatedly to update your position as you move. You may deny or revoke location access through your browser or device settings, but features that require location may not function without it.

If repeated GPS attempts cannot produce a usable reading, the Services may offer the adult account holder an optional photo-proof review. A proof submission includes the photo, its capture time, the best latitude, longitude, and accuracy reading the device can provide, the GPS failure reason, and the calculated distance from the idol when coordinates are available. Find the Idol staff use this information to approve or reject the collection request; submitting proof does not guarantee approval or award a point before review.

Location proof photos and their associated evidence are retained as needed to review the request, prevent fraud, resolve disputes, and maintain accurate game records. Do not include people or private information that are not necessary to prove your location. The adult account holder is responsible for the content submitted and may contact Find the Idol with a privacy or deletion request, subject to legal, fraud-prevention, and recordkeeping requirements.

A minor may not provide personal information directly through the Services or independently use features that collect account, device, location, or photo information. The adult account holder must personally control the account and device and is responsible for any information or content submitted through the account.

You must be at least 18 years old and capable of entering into a binding agreement to create, access, or control an account or join a game. You may not create an account for a minor or allow a minor to access, control, or independently use your account.

A minor may accompany and participate in physical gameplay only with the permission and direct supervision of their parent or legal guardian. The supervising parent or legal guardian must remain with the minor, determine whether each location and activity is appropriate, and personally operate all account-based features, including QR scans, location checks, photo uploads, invitations, and reward claims.

The adult account holder is responsible for the conduct and safety of every minor participating with them and for ensuring that each minor follows these Terms, the Game Policies, applicable laws, venue rules, and event instructions.

Find the Idol prohibits cheating and uses lawful anti-cheat measures to detect fraud, exploits, unauthorized software, falsified location data, and other attempts to interfere with the normal behavior or rules of the Services.

You use the Services at your own risk and may not use them to violate laws, policies, event instructions, or the rights of other people. You are expected to stay aware of your surroundings, communicate safely, and avoid trespassing, harassment, threats, or unsafe conduct.

Some Services require an account, a supported mobile phone, and an internet connection. You are responsible for activity under your account and must notify Find the Idol immediately about unauthorized use.

Find the Idol may suspend or terminate accounts for noncompliance, fraud, cheating, misuse of content or services, suspected unlawful activity, or long-term inactivity.

• Accessing Services in an unauthorized manner, including modified or unofficial third-party software
• Playing with multiple accounts for the same Service
• Sharing accounts
• Using techniques that alter or falsify a device's location, including GPS spoofing
• Selling or trading accounts

Subject to compliance with the Terms, Find the Idol grants a personal, noncommercial, nonexclusive, nontransferable, nonsublicensable, revocable, limited license to use content made available through the Services.

You retain ownership of your content. You grant Find the Idol a nonexclusive, worldwide, royalty-free license to store, process, and display content as needed to operate the feature through which you submit it. Service providers may exercise these rights only to support that purpose. GPS evidence is expressly excluded from the promotional permission below. Business and sponsor materials follow the applicable participation agreement.

Report suspected infringement to termsofservice@findtheidol.com with your contact information, identification of the work and the material at issue, its location in the Services, and the basis for your complaint. We may remove disputed material while reviewing the report and contact the submitter for a response.

Users remain responsible for their own content and represent that they have the rights needed to submit it without violating third-party rights, privacy rights, publicity rights, or applicable law.

If your content depicts, identifies, or includes personal information about a minor, you represent that you are the minor's parent or legal guardian or have obtained that parent or legal guardian's permission, and that you have authority to submit the content and grant the rights described in these Terms.

A location proof photo is reviewed only to decide the related collection request and for related safety, fraud-prevention, support, and dispute purposes. It is not a social-media submission or promotional license unless you separately submit it through a feature that expressly requests that permission.

When you voluntarily submit a bonus photo and optional caption after the upload notice, you authorize Find the Idol to share them with that game’s hosts and sponsors. You authorize Find the Idol and those hosts and sponsors to reproduce, crop, resize, use, and share them on their websites and social media to promote the game and participating locations. No additional payment is due; a submission approved by staff earns the stated one-point bonus. Pending or denied photos earn no bonus point. You can delete your uploaded photo on its idol task; deleting an approved photo removes that bonus point. A replacement may be uploaded only while the game and task accept photos and within 24 hours of the original idol collection. You may request removal from channels we control by emailing termsofservice@findtheidol.com. Existing third-party copies may remain. We will not use private GPS proof for promotion without separate permission. Incentivized endorsements must be identified where applicable and must remain truthful.

You are responsible for your conduct and user content while using the Services. Find the Idol reserves the right to investigate violations, remove content it considers objectionable or noncompliant, and cooperate with law enforcement where appropriate.

Any attempt to disrupt or interfere with the Services, including undermining or manipulating the legitimate operation of any site or app, is a breach of the Terms and may also violate civil or criminal law.

• Collecting, storing, or sharing personal information from other users without permission
• Extracting, scraping, or indexing the Services or gameplay information
• Using the Services or content for unapproved commercial purposes
• Attempting to access or download content through bots, crawlers, automation tools, or hacks
• Reverse engineering or bypassing technological protections
• Using Find the Idol trademarks, logos, layouts, or metadata without written consent
• Posting content that infringes third-party intellectual property or privacy rights
• Tampering with nonpublic systems or testing system vulnerabilities
• Forging headers or transmitting deceptive or false source information
• Interfering with access through viruses, flooding, spam, or similar attacks
• Deleting or obscuring attributions, warnings, or links in the Services
• Violating applicable law or helping others do any of the above

Events are in-person gatherings or activities organized, hosted, or managed by Find the Idol. By registering or buying tickets, you represent that the information you provide is true and accurate.

Only an adult may register an account for or use account-based features at an Event. A minor may attend or participate only with the permission and direct supervision of their parent or legal guardian, subject to any additional age, venue, ticket, or event-specific restrictions.

Game participation and collection are free. Any separately sold event admission or merchandise must identify its seller, price, restrictions, delivery and refund terms before purchase. Paid admission must not be a condition of earning points or eligibility for the standard game prizes. This section does not create a paid event or merchandise offer.

By attending an Event as an adult account holder, you acknowledge that Find the Idol may use your data for event features, including event updates, required materials, emergency notifications, public leaderboards, and gameplay competitions. A parent or legal guardian is responsible for reviewing any event notice and providing any permission required for a supervised minor.

You must comply with applicable law, venue rules, safety procedures, and instructions from venue staff and Find the Idol representatives. Illicit drugs, weapons, contraband, and illegal items are prohibited.

You acknowledge reasonably foreseeable risks from travel, terrain, weather, traffic, equipment, other people, and venue conditions. Follow authorized routes, business hours, and staff instructions. Nothing here releases liability that cannot lawfully be released, including liability for fraud, willful injury, or other nonwaivable rights.

Locations and access may change for safety or operational reasons. We will communicate material changes through the game or available contact channels. Game prizes, score corrections, and cancellation follow the Game Policies; paid business and sponsor services follow their accepted agreements.

Attendance alone does not grant unrestricted promotional rights to your likeness. Any organized promotional recording will use an appropriate notice and permission where required. Identifiable minors require permission from a parent or legal guardian. Bonus uploads follow the separate content permission above.

Participating businesses may offer rewards to players who successfully complete the collection requirements shown for an idol. Available reward details, redemption instructions, and expiration times are displayed through the Services.

Rewards and reward claims are associated with the adult account holder. A minor may not independently claim or redeem a reward through an account, and any participation by a minor does not create a separate account, collection, reward, or redemption right for that minor.

Rewards are offered and fulfilled by the participating business identified in the reward details. A participating business may apply reasonable redemption conditions disclosed with the reward, including availability, operating hours, purchase limitations, and limits on how many times a player may claim it.

Find the Idol provides the technology used to assign and display these rewards but does not independently promise or fulfill a reward unless Find the Idol is expressly identified as its provider. Questions or disputes about fulfillment should first be directed to the participating business.

Business offers are optional predetermined benefits, not random prizes. Each first collection receives at most one offer active when the award is issued; repeat scans do not issue, renew, or replace an offer, including where no offer was available originally. Already-issued offers retain their saved instructions and expiration after later edits.

Business offers in the standard four-week Find the Idol game expire 24 hours after issuance; custom games use the expiration displayed with the offer. For approved GPS proof, offer issuance occurs at approval. An optional offer may require a disclosed purchase, but gameplay, points, and standard leaderboard-prize eligibility never require one. Business refusal or closure should be reported to us if the business cannot resolve it; mandatory consumer rights remain available.

Game leaderboard prizes are separate from business offers and follow the Game Policies. A game may use increasing reward tiers based on how many distinct eligible players collect at least one idol; its first tier may also have no minimum-player restriction. The game page automatically shows the prize amounts for the highest tier reached. Points are scoring records, not money, credit, purchased entries, or a cash balance. An advertised prize does not create a right to payment before any participation condition and winner verification are satisfied.

The Services may link to third-party websites or resources. Find the Idol provides those links only as a convenience and is not responsible for their content, products, services, availability, or quality.

Third-party networks, maps, websites, and business services may affect availability and are governed by their own applicable terms and privacy policies. Paid sponsorship is recognition of a commercial relationship, not a guarantee of a sponsor’s goods or services.

To the extent permitted by law, the Services and content are provided "as is" without warranties of any kind, including merchantability, fitness for a particular purpose, quiet enjoyment, or noninfringement.

We do not guarantee uninterrupted or error-free access, GPS accuracy, continued availability of a particular location, or the conduct of third parties. These limitations do not cancel expressly promised prizes, issued offers, refunds, or rights required by law.

To the fullest extent permitted by law, Find the Idol and any party involved in creating, producing, or delivering the Services or content are not liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, loss of data, goodwill, service interruption, computer damage, system failure, or the cost of substitute services.

To the extent permitted by law, our aggregate liability for claims under these Terms is limited to $1,000. The exclusions and cap do not apply to fraud, willful misconduct, liability that cannot lawfully be limited, or our obligations to pay expressly promised prizes or refunds. Separate business agreements govern business-service claims.

Please first contact termsofservice@findtheidol.com with a description of your dispute and requested resolution. This informal process does not prevent urgent relief, a small-claims filing, or action necessary to preserve a legal deadline.

Except for the exceptions below, you and Find the Idol agree to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and Mediation Procedures in effect when the claim is filed. The Federal Arbitration Act governs this arbitration provision. Current rules and filing instructions are available at https://www.adr.org/rules-forms-and-fees/consumer/. Hearings may be remote or at a reasonably convenient location under those rules. Fees and fee waivers follow the consumer rules and applicable law; we pay amounts those rules assign to the business.

Arbitration replaces a court trial and jury for covered claims. You and Find the Idol waive class or representative adjudication of covered claims to the extent lawful. Either party may use an eligible small-claims court, seek court protection of intellectual property, and pursue relief that applicable law does not permit to be waived or arbitrated, including public injunctive relief where protected. Courts decide enforceability and scope of this arbitration provision. If the class waiver is unenforceable for a claim, that claim proceeds in court; remaining covered claims may proceed individually in arbitration.

You may opt out of arbitration by emailing termsofservice@findtheidol.com within 30 days after first accepting these Terms, identifying your account, contact information, and clear decision to opt out. An earlier valid opt-out remains effective. Opting out does not affect your use of the Services. Material changes to this arbitration provision do not apply to a dispute already known to either party without agreement. If AAA cannot administer a dispute and the parties cannot agree on an alternative, either may proceed in a competent court.

California law governs these Terms, subject to the Federal Arbitration Act and mandatory consumer protections where you live. Where litigation is permitted, the parties consent to competent state courts in Monterey County, California, and the federal court with jurisdiction there, except where applicable law or small-claims rules permit another venue.

These Terms and the incorporated Game Policies form the agreement for account use and gameplay. The Privacy Policy explains data handling. Specific game rules may add clearly disclosed details but cannot retroactively reduce earned rights. Accepted business and sponsorship agreements govern those paid services.

If a provision is invalid, the rest remains effective, subject to the arbitration-specific rule above. A failure to enforce a provision is not a waiver. You may not transfer your account or obligations without our consent. We may transfer the Services to a successor that assumes our obligations. Events beyond reasonable control may delay service, but do not automatically extinguish prize or refund obligations. Notices may be sent through the Services or your provided contact information. Provisions that by their nature must survive termination, including accrued obligations and dispute provisions, survive.
