Terms of Service

Effective as of April 8, 2023

We are 8bit Company LLC, doing business as Find the Idol. Find the Idol is a community-driven outdoor treasure hunt built around discovery, environmental stewardship, local exploration, websites, mobile game applications, events, promotions, merchandise, and related services.

By using the Services, you agree to these Terms. If you do not agree, you may not use the Services. Find the Idol may modify these Terms by posting updated versions on the site or in the app, and your continued use means you accept the updated Terms.

If you breach these Terms, Find the Idol may take action against you, including suspending or terminating your account. Find the Idol does not reimburse or refund Services lost because of involuntary suspension or termination caused by a breach.

1. Terms

These Terms govern your use of the Find the Idol apps, websites, events, merchandise, and related services.

The Terms also work alongside any applicable game guidelines and policies communicated through the site, apps, or event materials.

2. Privacy

Find the Idol collects and uses information only where it has a legal basis to do so. The legacy terms direct users to the Privacy Policy for details about what information is collected, how it is used, and what choices users have.

3. Use of the Services

Find the Idol prohibits cheating and uses lawful anti-cheat measures to detect fraud, exploits, unauthorized software, falsified location data, and other attempts to interfere with the normal behavior or rules of the Services.

You use the Services at your own risk and may not use them to violate laws, policies, event instructions, or the rights of other people. You are expected to stay aware of your surroundings, communicate safely, and avoid trespassing, harassment, threats, or unsafe conduct.

Some Services require an account, a supported mobile phone, and an internet connection. You are responsible for activity under your account and must notify Find the Idol immediately about unauthorized use.

Find the Idol may suspend or terminate accounts for noncompliance, fraud, cheating, misuse of content or services, suspected unlawful activity, or long-term inactivity.

The legacy terms state that children are not allowed to use the Services unless otherwise stated for a particular Service, and define a child as a person under 13 years old.

  • Accessing Services in an unauthorized manner, including modified or unofficial third-party software
  • Playing with multiple accounts for the same Service
  • Sharing accounts
  • Using techniques that alter or falsify a device's location, including GPS spoofing
  • Selling or trading accounts

4. Content and Content Rights

Subject to compliance with the Terms, Find the Idol grants a personal, noncommercial, nonexclusive, nontransferable, nonsublicensable, revocable, limited license to use content made available through the Services.

Find the Idol does not claim ownership of user content, but the legacy terms grant Find the Idol a nonexclusive, transferable, sublicensable, worldwide, royalty-free, perpetual license to use, display, perform, market, promote, and distribute user content in connection with operating the Services.

Users remain responsible for their own content and represent that they have the rights needed to submit it without violating third-party rights, privacy rights, publicity rights, or applicable law.

Feedback submitted to Find the Idol is treated as user content, and the legacy terms also state that Find the Idol follows a DMCA-style intellectual property policy for infringement complaints.

5. Conduct, General Prohibitions, and Enforcement Rights

You are responsible for your conduct and user content while using the Services. Find the Idol reserves the right to investigate violations, remove content it considers objectionable or noncompliant, and cooperate with law enforcement where appropriate.

The legacy terms state that any attempt to disrupt or interfere with the Services, including undermining or manipulating the legitimate operation of any site or app, is a breach of the Terms and may also violate civil or criminal law.

  • Collecting, storing, or sharing personal information from other users without permission
  • Extracting, scraping, or indexing the Services or gameplay information
  • Using the Services or content for unapproved commercial purposes
  • Attempting to access or download content through bots, crawlers, automation tools, or hacks
  • Reverse engineering or bypassing technological protections
  • Using Find the Idol trademarks, logos, layouts, or metadata without written consent
  • Posting content that infringes third-party intellectual property or privacy rights
  • Tampering with nonpublic systems or testing system vulnerabilities
  • Forging headers or transmitting deceptive or false source information
  • Interfering with access through viruses, flooding, spam, or similar attacks
  • Deleting or obscuring attributions, warnings, or links in the Services
  • Violating applicable law or helping others do any of the above

6. Participation in Events

The legacy terms define Events as in-person gatherings, activities, or promotions organized, hosted, or managed by Find the Idol. By registering or buying tickets, you represent that the information you provide is true and accurate.

Except where required by law, no refunds or exchanges of event tickets or add-ons are permitted, tickets are non-transferable, and proof of identity may be required. Tickets from unauthorized sources may be invalid, counterfeit, or revoked.

By attending an Event, you acknowledge that Find the Idol may use your data for event features, including event updates, required materials, emergency notifications, public leaderboards, and gameplay competitions.

You must comply with applicable law, venue rules, safety procedures, and instructions from venue staff and Find the Idol representatives. Illicit drugs, weapons, contraband, and illegal items are prohibited.

Unless prohibited by law, the legacy terms require you to assume the risks of attending or participating in Events, including injuries, obstacles, equipment issues, weather, terrain, wildlife, other participants, and damage or theft of property.

Event schedules, features, rewards, activities, locations, and experiences may change or be canceled without notice. If an Event is canceled, suspended, or rescheduled and you cannot attend, compensation is limited to a refund of the ticket face value.

The legacy terms also allow Find the Idol to record your image, likeness, name, dialogue, voice, and biographic information at Events and use that material in promotional, marketing, and social media content.

7. Sweepstakes, Contests, Raffles, Rewards, Surveys, and Similar Promotions

Promotions may have additional promotional terms that control alongside or instead of these Terms. By participating in a Promotion, you agree to the applicable promotional terms, and the Privacy Policy also applies to information submitted through those promotions.

8. Third-Party Websites or Resources

The Services may link to third-party websites or resources. Find the Idol provides those links only as a convenience and is not responsible for their content, products, services, availability, or quality.

The legacy terms also disclaim responsibility for third-party networks, hotspots, wireless internet, and other services that may affect your ability to use the Services or participate in an Event.

9. Disclaimer of Warranties

To the extent permitted by law, the Services and content are provided "as is" without warranties of any kind, including merchantability, fitness for a particular purpose, quiet enjoyment, or noninfringement.

The legacy terms also state that Find the Idol does not guarantee uninterrupted, secure, or error-free service and does not warrant the conduct of other users, the quality of content, or the outcome of user interactions online or offline.

10. Limitation of Liability

To the fullest extent permitted by law, Find the Idol and any party involved in creating, producing, or delivering the Services or content are not liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, loss of data, goodwill, service interruption, computer damage, system failure, or the cost of substitute services.

The legacy terms cap Find the Idol's total liability arising out of or connected with the Terms, an Event, or the use of or inability to use the Services or content at one thousand dollars ($1000), to the extent permitted by law.

11. Dispute Resolution

The legacy terms state that, where allowed by law, disputes between you and Find the Idol are resolved by binding, individual arbitration, and that users waive the right to a jury trial or to participate in class or representative proceedings.

The arbitration section references the American Arbitration Association Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes, with carve-outs for small claims court and certain intellectual property protection actions.

Users may opt out of arbitration by emailing termsofservice@findtheidol.com within thirty days after first accepting the Terms, as described in the legacy terms.

The legacy terms also provide for California governing law and exclusive venue in the state and federal courts located in the Northern District of California where litigation is permitted.

12. General

The legacy terms provide that they are the entire agreement between Find the Idol and the user regarding the Services and content.

If any provision is held invalid or unenforceable, the remaining provisions stay in effect. The terms also address assignment, force majeure, notices, waiver, and other standard general provisions.
